Musmat.com is an online and (offline magazine) matrimonial service operated and owned by The Muslim Matrimonial. (“The Muslim Matrimonial”), comprising information provided by website and catalogue under the label Musmat.com (all referred to in these Terms as either “Musmat” or "Musmat.com" or "The Muslim Matrimonial").

Musmat.com is a free as well as a pay to use service and these terms and conditions (“Terms”) apply to all and any use of Musmat.com, the purchase of services and information (“Services”) and all and any postings, emails, text messages, SMS and other communications made to or using it or any message board or similar services run by Musmat.com (“Communications”).

By using Musmat.com You agree to be bound by these Terms.

If You do not accept these Terms you should not use Musmat.com.

If You do not accept these Terms You should not make any Communications.

In consideration of the payment by You to Musmat.com, Musmat.com agrees to provide to You the Services with reasonable and due care in accordance with and subject to these Terms.

You may only be contacted by other users or by Musmat.com staff. For the avoidance of doubt, other users include users of any Service provided by Musmat.

You will co-operate with and act in good faith towards Musmat.coml and provide on request Your published description, including Your geographical location and Your profile identification number (“Profile”), and Your contact details including Your name, Your geographical location, Your profile identification number, Your email address and if You have consented, Your telephone number ("Contact Details"). Profile and Contact Details collectively mean Information. You must provide on request Information as Musmat.com incorporatse on to the Services or Musmat.com requires to carry out its obligations hereunder.

The Musmat.com reserves the right to:

• refuse or terminate membership;

• withhold Contact Details;

• limit the number of Contact Details taken per month by You;

• otherwise do any act in relation to Services as shall be reasonably necessary to preserve the integrity of Musmat.com, the Services and comply with relevant laws and regulations;

• any Communications that You make whilst using the Services; and

• amend Profiles in terms of length, spelling and grammar. You will be notified of such changes by email.

All Communications sent by Musmat.com and attachments thereto are intended only for the addressee and/or others authorised to receive them.

On entering this Agreement and using the Services, You must be 18 years of age or older.

At the time that you register for membership with Musmat.com, You must be legally able to marry.

Use of the Services is strictly limited to the purpose of seeking a marriage partner and for the avoidance of doubt, use of the Services for dating purposes is strictly prohibited.

Commercial use of the Services is strictly forbidden, unless the prior written approval of Musmat.com is obtained.

You are restricted to the access of Contact Details of other users.

You should promptly acknowledge the receipt of all Communications that You receive whilst using the Musmat Service.

Use and access of third party websites are made at Your own risk.

You are responsible for keeping Your login password and username confidential.

You are responsible for all activity taking place via Your account.

You are wholly responsible for checking the accuracy of Information given to You by other users.

You undertake that the Profile that You provide to Musmat.com does not include any personally identifying details or Contact Details, including but without limitation, Your name, telephone number, e-mail address, home address, URL, or the name of the company for which You work.

You are restricted to printing Profiles of other users for personal use only. For the avoidance of doubt, Services, including but without limitation to e-mail addresses and phone numbers should never be passed to third parties. Services are restricted to the personal and sole use of You. Further, if You are no longer to use the Information for the purpose of finding a marriage partner, You must destroy the Information.

An option exists whereby users can request that their telephone number is not made available to other users.

Musmat.com shall be entitled to at it’s discretion in the future gain Information from other sources and/or agencies and publish the same through any of its Services. In respect of such future services, users will be permitted to contact such agencies and/or the members of such agencies, but such agencies are prohibited from contacting users and soliciting business from users.

Musmat.com shall be entitled to at it’s discretion modify the Services and any such modifications are subject to this Agreement.

Individuals other than prospective users are permitted to take out membership of Musmat.com's Services for the use of prospective users provided that such individuals have obtained the prior consent of prospective users. For the avoidance of doubt, where individuals obtain membership on behalf of a prospective user (e.g a father on behalf of a daughter), both the prospective user and the individual taking out the membership will be bound by this Agreement. Information gained by such an individual is restricted to use by the prospective user only, and for the avoidance of doubt, cannot be used by another individual.

By prior verbal or written request by You to Musmat.com, Musmat.com may assist you in drafting Your Profile. Such assistance is based on sufficient information provided by You to Musmat.com, You checking the accuracy of the Profile, and for the avoidance of doubt, Musmat.com is not responsible for the accuracy of the Profile.

You must comply with all requirements, procedures, policies and regulations relating to networks connected to the Musmat website.

You may use Musmat for your private, non-commercial, personal use only, provided that You retain all copyright notices and other proprietary notices contained on Musmat.com. You may not sub-licence or deal in this right without Musmat.com's prior written permission.

All copyright, design rights, database right, patents, and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any applications therefor (“Intellectual Property Rights”) in Musmat belong to and vest in The Muslim Matrimonial, or are licensed to The Muslim Matrimonial unless otherwise specified. All such rights of The Muslim Matrimonial are hereby asserted and reserved.

No person other than the rightful owner or licensee of such Intellectual Property Rights may:

• hack, attempt to hack, distribute, modify, transmit, re-use, re-post, or use any or all of Musmat or the information contained therein for any purpose other than as set out above nor for public or commercial purposes without The Muslim Matrimonial’s or the relevant licensee’s prior written permission;

• provide hypertext links, URL Links, graphic links, hyperlinks or other direct connection whether for profit or gain or any other purpose to Musmat without The Muslim Matrimonial’s prior written permission;

• display, publish, copy, print, post or otherwise use Musmat and the information contained throughout for the benefit of any other website and/or service without The Muslim Matrimonial’s or the relevant licensee’s prior written permission;

• process or otherwise use the information contained on or within Musmat for any illegal or immoral purpose nor use or process the same unfairly.

You shall grant to The Muslim Matrimonial a non-exclusive licence to use the Information for all purposes relating to this Agreement and to The Muslim Matrimonial’s Services including but without limitation to any media now existing or hereinafter created or any third parties to publish such Information; and warrant that You have obtained and are fully entitled to grant The Muslim Matrimonial these rights and that the Information is free of racist, defamatory, obscene and other legally restricted material.

Where Musmat.com permits third parties to publish Information, restricted to Profiles only, third parties reading the Information may only respond to Musmat.com directly. Musmat.com will then forward these responses to You. For the avoidance of doubt telephone numbers or e-mail addresses will only be passed on to users and further, unless required to do so by law, Musmat.com will never disclose Your address to any third party.

Each Party undertakes that it will keep secret and confidential any Information supplied by either party in connection with this Agreement or in connection with the business of the other and PROVIDED THAT this Clause shall not extend to information which was and can be shown to be rightfully in the possession of You prior to the commencement of the negotiations leading to this Agreement or which is in the public domain (other than as a result of a breach of this Clause).

You shall not modify, adapt or translate the Information without the prior written consent of Musmat.com or as otherwise permitted by law where all modifications, adaptations, translations shall belong to and vest in The Muslim Matrimonial.

From time to time Musmat.com may ask for and /or You may choose to submit personal data to Musmat.com or The Muslim Matrimonial (including your Contact Details) for purposes of identification, billing and marketing.

You agree and accept that this data may be used, stored and processed to improve the operation, administration and development of Musmat and The Muslim Matrimonial; to process orders and improve The Muslim Matrimonial's service, as well as for marketing, advertising and promotional purposes but only in accordance with the Data Protection Act 1998. In particular, You agree that:

• Musmat.coml may use the Information or parts of it to notify You about Musmat.com features and/or events or related activities that You may find useful.

Payment must be received by Musmat.com by You before You can use the Premium Membership Services.

On giving You reasonable notice Musmat.com reserves the right to alter fees.

Except and unless expressly authorised in writing by You Musmat.com will not be permitted to alter the membership charges if Your membership payment is through recurring monthly payments.

If You have not used the Services to obtain any Information, You are entitled to a refund within 7 days of entering into this Agreement.

You are not entitled to a refund of unused Contact Credits or period of membership if You become engaged or terminate this Agreement, or once you have requested contact details of other members.

Musmat.com is engaged in the business of providing a matrimonial service and ancillary to this is engaged in the transmission, storage, retrieval, hosting, formatting or translation of third party communications without selection or alteration of the content of the communication for which it is a mere conduit. You agree and accept that Musmat.com has no responsibility to review the content of the Communications on Musmat all of which are made available on the basis that Musmat.com shall not be required to exercise any control or judgement of the content or the material posted or contained therein.

The views expressed in any Communications are the views of the individual authors and not those of Musmat.com unless specified otherwise by Musmat.com. In particular but without limitation to the above Musmat.com is not responsible for and disclaims all liability in respect of any comments, views or remarks expressed in any Communications.

Musmat.com gives no warranty and makes no representation as to the accuracy, currency or validity of the information and material contained within the Communications or Musmat.com and shall not be responsible for any loss or damage caused as a result of any use of such material.

You agree and undertake that you will not post or transmit to, through or using Musmat.com any statement, action, material or Communication that:

• is unlawful or which gives rise to civil or criminal liability;

• is technically harmful such as computer viruses, worms, logic bombs or other malicious software or harmful data;

• is defamatory, libellous, untrue, discriminatory, obscene, inflammatory or racist material whatsoever.

You agree to indemnify and hold harmless Musmat.com against all liability it may have in respect of and arising out of Your use of Musmat.com Services and your Communications.

The Muslim Matrimonial provides and maintains Musmat.com for personal matrimonial services, on an “as is” basis. The Muslim Matrimonial shall be liable only to provide its services with reasonable skill and care and gives no other warranty in connection with Musmat.com.

Subject as aforesaid, to the maximum extent permitted by law, The Muslim Matrimonial excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect, punitive or consequential loss whether or not such arises out of any problem you notify to Musmat.com and The Muslim Matrimonial shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

• any incorrect or inaccurate information on Musmat.com and all interruptions to or delays in updating the service;

• the infringement by any person of any Intellectual Property Rights of any third party caused by their use of Musmat.com;

• any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading Musmat.com, or from transmissions via emails or attachments received from Musmat.com or its licensees;

• the availability, quality, content or nature of the other sites on the internet that are owned and operated by third parties ("External Sites") to which Musmat.com links and web sites located on or through any External Site nor for any transactions involving External Sites (including as to 'cookies', personal data, confidential information, or purchases of domain names or other services). You should contact the site administrator or webmaster for those External Sites if you have any concerns regarding such links, web site or transactions; and

• all representations, warranties, conditions and other terms which but for this notice would have effect.

Musmat.com recommends the following guidelines to You when You are meeting prospective partners whilst acting on Your own.

only meet during daylight hours;

always hold meetings in busy public places; and

always be accompanied to the meeting by someone you know.

Musmat.coml shall be entitled to terminate this Agreement and immediately remove, cancel or suspend access to and use of Musmat.com upon Your breach of any part of these Terms whatsoever.

Termination shall be without prejudice to the accrued rights of either party.

You shall be entitled to terminate this Agreement at any time.

Except as provided above there are no other warranties, conditions or other terms, express or implied, statutory or otherwise, and all such terms are hereby excluded to the maximum extent permitted by law (but subject to Your statutory and common law consumer rights).

If Musmat.com does not enforce any provision of this Agreement such will not be considered a waiver of any provision or right.

In the event that any part of this Agreement is held to be unenforceable, such part will at Musmat.com's option be construed as far as possible to reflect the parties’ intentions and the remainder of the provisions will remain in full force and effect.

This Agreement constitutes the entire Agreement between You and Musmat.com and shall apply to the exclusion of all other terms or conditions of contract which you may purport to propose.

This Agreement supersedes any previous Agreement that You have entered into with Musmat.com

Use of Musmat.coml and these Terms are subject to the laws of England which shall exclusively govern the interpretation, application and effect of all the above permissions, exclusions, licences and conditions of use and shall be construed in accordance with the laws of England and the parties submit to the exclusive jurisdiction of the English courts.

The Muslim Matrimonial and Musmat.com are based in the UK and no representation or warranty is made as to whether The Muslim Matrimonial and Musmat complies with the regulatory regime and local laws of any other countries.
